Demo für eine dritte Option beim Geschlechtseintrag – Einreichen der Verfassungsbeschwerde

Im Juli 2014 haben wir Vanja dabei begleitet, einen Antrag auf die geschlechtliche Bezeichung „inter/divers“ in der Geburtsurkunde beim Standesamt Gehrden/Hannover zu stellen. Das Amtsgericht Hannover und das Oberlandesgericht Celle haben abgelehnt. Nun hat auch der Bundesgerichtshof entgegen unserer Vorstellungen entschieden, doch für uns ist der Weg nicht vorbei – der spannendste Teil beginnt erst! Wir werden Vanja darin unterstützen eine Verfassungsbeschwerde beim Bundesverfassungsgericht einzureichen. Es wäre toll, wenn auch ihr das tut und mit uns zusammen das Anliegen auf die Straße tragt. Warum eigentlich?
Wir, die Kampagne für eine dritte Option beim Geschlechtseintrag, wollen Raum und Sichtbarkeit schaffen für alle Geschlechter jenseits von Mann* und Frau*.
Immer wieder wird behauptet es gäbe eine “Natürlichkeit” von genau zwei Geschlechtern. Dabei wird diese erst mit Gewalt hergestellt – durch Operationen an intergeschlechtlichen Kindern ohne deren Zustimmung, durch das Pathologisieren, also für krank erklären, von Inter* und Trans*, durch das Unsichtbar machen und Ignorieren von allen, die jenseits von Mann* und Frau* existieren.
Menschen, die nicht als Mann* oder Frau* leben, sind keine neue Erscheinung. Sie gab es schon immer und wird es immer geben. Es wird Zeit für eine rechtliche Anerkennung dieser Tatsache. In einigen Ländern (z.B. Australien, Indien und Nepal) ist dies auch zum Teil seit Jahren schon möglich.
Also, es reicht! Wir als Inter*, Trans*, Queers sind nicht krank oder gestört,wir werden höchstens gestört. Wir haben ein Recht auf Geschlecht wie alle anderen auch.
Durch eine dritte Option beim Geschlechtseintrag kann die Existenz von Menschen, die weder Frau* noch Mann* sind, nicht länger geleugnet werden. Wir sind, wer wir sind – völlig unabhängig von Kästchen auf staatlichen – und sonstigen – Formularen. Aber die symbolische Anerkennung durch eine dritte Option beim Geschlechtseintrag ist ein großer Schritt heraus aus gesellschaftlicher Unsichtbarkeit und Marginalisierung. Darüber hinaus kann diese Anerkennung den Weg zur Abschaffung weiterer Diskriminierungen ebnen und hoffentlich dazu beitragen, dass endlich die “Umoperationen” von intergeschlechtlichen Kindern – ohne deren Zustimmung und ohne medizinische Notwendigkeit -, gegen die Aktivist*innen bereits seit Jahren kämpfen, endgültig beendet werden.
Diese Menschenrechtsverletzungen sind nicht länger hinzunehmen. Darum lasst uns das Recht auf Selbstbestimmung juristisch und gesellschaftlich erkämpfen!
Lasst uns der Welt zeigen, dass es uns gibt und dass wir uns nicht verstecken, sondern selbstbewusst und selbstverständlich für unsere Rechte einstehen! Auch Unterstützer*innen sind herzlich willkommen.

For September 2nd we – the advocacy group Dritte Option (= Third Option) – are organising a demonstration in Karlsruhe for a third gender option in official documents. That day we’ll submit a complaint against the ruling of the Federal Court of Justice that rejected our appeal to the Federal Constitutional Court. The demonstration starts at 5 pm at the Federal Court of Justice (Bundesgerichtshof), Herrenstr. 45a, Karlsruhe.

Please find below some information and comments on our appeal to have a third gender option introduced in a birth certificate and its rejection by the Federal Court of Justice:
Accompanied by our advocacy group, Vanja had requested a respective modification of their birth certificate at a registry office in July 2014. The request was forwarded to the district court in Hanover where it was rejected. We submitted a complaint to the appellate court in Celle that, too, rejected it. Consequently, we took the complaint to the Federal Court of Justice, the highest appellate court in Germany for civil and criminal cases. As announced on August 3rd, the Court rejected the complaint on June 22nd, 2016.
Whereas in its ruling the Federal Court of Justice acknowledges the existence of individuals who are not represented by ‘male’ or ‘female’ – i.e. at present the only available categories in the German birth register, passports, etc. – it stipulates that there is no need and no legal ground for the introduction of a third gender option. The Court states that such a third option would rather be of a “declaratory” nature and that it suffices that intersex individuals can resort to the possibility to have their gender description removed from the birth register (and that parents may decide to leave the category ‘gender’ of their intersex children blank). While the possibility to erase an existing gender description from the birth register – a clarification of the recently modified § 22 Section 3 PStG that was provided by the appellate court in Celle with regard to Vanja’s case – constitutes a success in the struggle to overcome the binary of legal gender, it is not sufficient in order to guarantee intersex and other non-binary individuals the constitutional rights to human dignity, freedom of the person and legal equality.
We, the advocacy group Dritte Option, consider the Court’s ruling inconsistent. The Court itself highlights individuals’ right to have their gender identity recognised and respected but makes a distinction between transgender people who have – finally – been granted the right to change their gender description in official German documents from ‘female’ to ‘male’ and vice versa, and intersex and e.g. non-binary people who shall be denied the right to a category reflecting their gender identity.
As Vanja points out, “the introduction of a third gender option in passports and other documents would finally acknowledge the existence of intersex people and other individuals who do not identify as either male or female. With regard to anti-discrimination acts and policies as well as for the way I feel accepted – or not – by the German State it does make a huge difference if I can point to my officially registered gender or if I have to refer to some blank space.”

We fight for a third gender option that is open to everyone, and its selection to be exclusively based on the decision of each individual. We are glad to have received support from numerous individuals who are awaiting the official recognition of their gender identity – the Court’s ruling constitutes a blow for all of them and others in Germany and beyond.
In other countries, similar struggles have been already successful – like in Australia, for example – or are under way, as it is the case in Austria. Furthermore, these efforts for a third gender option in official documents draw on and support the decade-long work of intersex organisations fighting for self-determination and bodily integrity of intersex people, especially with regard to operations on intersex children without their consent.
